Welcome to CacheWith.ME. These Terms of Service (“Terms”) govern your access to and use of the CacheWith.ME mobile application and website (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Description of Service

CacheWith.ME is a social platform that enables cachers to connect, organize, and participate in group caching activities (“Crusades”). The Service includes:

  • Creating and discovering caching crusades
  • Messaging and communication features
  • Friend connections and social features
  • Location-based discovery
  • User profiles and statistics

5. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Harass, abuse, threaten, or intimidate other users
  • Post content that is defamatory, obscene, pornographic, or offensive
  • Impersonate any person or entity or misrepresent your affiliation
  • Share your account credentials or allow others to access your account
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to other accounts or systems
  • Use automated scripts, bots, or other means to access the Service
  • Collect or harvest personal information about other users without consent
  • Use the Service to spam or send unsolicited messages
  • Create crusades with false or misleading information
  • Violate any caching community guidelines or trespass on private property

6. User Content

6.1 Ownership

You retain ownership of content you create on the Service (profile information, crusade details, messages, etc.). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with operating the Service.

6.2 Responsibility

You are solely responsible for the content you post. We do not endorse or guarantee the accuracy of any user content. You represent that you have the right to post any content you submit.

6.3 Removal

We reserve the right to remove any content that violates these Terms or that we find objectionable, without notice.

7. Subscriptions and Payments

7.1 Optional Subscriptions

We may offer optional paid subscriptions to support the development of CacheWith.ME. Subscriptions are processed through the Apple App Store or Google Play Store.

7.2 Billing

Subscription fees are billed in advance on a recurring basis. Your subscription will automatically renew unless you cancel before the renewal date.

7.3 Cancellation

You can cancel your subscription at any time through the App Store or Google Play Store settings. Cancellation takes effect at the end of the current billing period.

7.4 Refunds

Refund requests are handled by the respective app store (Apple or Google) according to their policies.

8. Location Services

The Service uses location data to provide features such as distance calculations and crusade discovery. By enabling location services:

  • You consent to the collection and use of your location data as described in our Privacy Policy
  • You acknowledge that location data may not always be accurate
  • You are responsible for your own safety when traveling to crusade locations

9. Safety and Liability

CacheWith.ME is a platform for organizing caching activities. We do not supervise, control, or participate in crusades. You participate in all caching activities at your own risk.

  • Always follow local laws and regulations when caching
  • Respect private property and do not trespass
  • Exercise caution when meeting other users in person
  • We are not responsible for the actions of other users
  • We are not responsible for any injuries, damages, or losses that occur during caching activities

10. Data Storage

All data collected and stored by CacheWith.ME is processed and stored on servers located in the United States.

By using the Service, you consent to the transfer, processing, and storage of your data in the United States, regardless of your country of residence.

11. Intellectual Property

The Service and its original content (excluding user content), features, and functionality are owned by CacheWith.ME and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent.

12. Third-Party Services

The Service may integrate with or link to third-party services (e.g., app stores, maps). We are not responsible for the content or practices of third-party services. Your use of third-party services is subject to their respective terms and policies.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CACHEWITH.ME AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

15. Indemnification

You agree to indemnify and hold harmless CacheWith.ME and its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

16. Termination

We may terminate or suspend your account and access to the Service at any time, without prior notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
